What is an E–Work Permit? Employers/business establishments must know.

E-Workpermit In Thailand, it is the electronic work permit application system for foreign workers, developed by the Department of Employment, Ministry of Labor, to facilitate foreign workers and employers, reduce procedures, and provide convenience in submitting applications and tracking the status of work permits. This system helps make the process faster and more efficient. The E-Work permit system aims to increase transparency and reduce complicated procedures in applying for work permits for foreign workers in Thailand.

What is the MOU for foreign workers? 

The signing of an MOU or Memorandum of Understanding is a contractual condition between Thailand and neighboring countries to legally bring foreign workers into Thailand to work under the MOU between the Thai government and the countries of origin: Laos, Burma, Cambodia, and Vietnam. The resolutions for signing the MOU between Thailand and these four countries will differ according to the following conditions: 

  • Laos signed an MOU on employment on October 18, 2002.
  • Cambodia signed an MOU on employment on May 31, 2003.
  • Myanmar signed an MOU on employment on June 21, 2003.
  • Vietnam signed an MOU on employment on July 23, 2015. 

“If the worker complies with the MOU requirements correctly, they will be able to reside in the Kingdom of Thailand and work in accordance with the applicable laws.” 

Why do foreign workers need to sign an MOU?

“The employment of migrant workers in Thailand plays an important role in supporting various sectors of work, contributing to the driving force of the economy and multiple industries. To ensure that employment is carried out legally, reduce inhumane human trafficking issues, and prevent illegal entry into the country, migrant workers are required to follow the regulations and procedures stipulated, which is the MOU process. Migrant workers who enter through the MOU system will receive welfare benefits as prescribed by law and will have complete identification documents.”

“Qualifications of foreigners who wish to apply for a work permit in Thailand” As follows:

  1. “Have a valid passport.” “Must have a passport that is still valid and legally recognized.”
  2. “Have an employer in Thailand.” “Must have an employer who can certify and offer employment, and the employer must be registered in the e-work permit system.”
  3. “Have an occupation that is permitted.” “Must work in an occupation permitted by the Department of Employment, which specifies the types of jobs that foreign workers are allowed to do.”
  4. “Have the appropriate qualifications and skills.” “Must have qualifications such as education and work experience appropriate for the job applied for, and some occupations may have specific requirements.”
  5. No criminal history “Must not have any significant criminal record, which may be considered during the approval process.”
  6. “Must be in good health and physically fit.” “Must be in good health, and may be required to provide a medical certificate in cases where specific conditions apply.”
  7. “Must not be a person who is prohibited from entering the country.” “Must not fall under the categories of persons prohibited from entering Thailand under the law.”

  • : It promotes cooperation between countries. : It is cooperation between countries in managing migrant labor, promoting the exchange of useful information and experience.
  • : Effective management of labor. : Helps in controlling and managing the movement of labor in a systematic way, allowing for better monitoring and management of migrant workers.
  • : Reduces problems caused by illegal workers and illegal immigration. : The MOU helps reduce illegal entry and employment of migrant workers, which may negatively impact the country’s economy and society.
